Tom has nearly a decade of experience advising claimants, law firms, litigation funders and institutional investors on all aspects of litigation finance and litigation risk insurance, and now also leads Exton’s corporate finance business, which advises law firms and other legal services business on launches, capital raising and mergers and acquisitions.

Tom is consistently ranked in all the leading directories, including as a thought leader by Whose Who Legal, a Tier 1 individual by Chambers & Partners, and amongst LawDragon’s 100 global leaders in litigation finance. In addition, Tom is a published author on litigation finance and speaks regularly at conferences and other events.

Recent work highlights include:
Claimant
  • Advised claim holders on financing for claims against Credit Suisse relating to the write-down of Additional Tier-1 bonds;
  • Advised a Singaporean entity on financing for USD 100m+ SIAC arbitration relating to breach of a JV agreement;
  • Advised an insolvency practitioner on GBP 100m+ claims against auditors arising from the liquidation of a listed entity;
  • Advised a Swiss company on financing for a treaty arbitration against an Eastern European state; and,
  • Advised several funded parties, including Class Representatives and Steering Committees, on the amended terms of financing as a consequence of the Supreme Court of the United Kingdom’s decision in PACCAR.

  • Advised a London law firm on financing to support Damage Based Agreements in relation to several securities group actions.
Funder & investors
  • Advised a LP on the secondary market sale of their interest in several litigation finance funds; and,
  • Advised a US credit fund in relation to the financing of several portfolios of claims being pursued in England & Wales and, separately, Continental Europe.
